leave my indian employer soon. they are saying they have 90 days notice period.... which was set from india. I work in ohio which has "employment at will" law... I am not going to serve the full notice period..... but if they deduct any money..... I am going fight like hell.... planning to complain to DOL and state govt office......I will keep updated on what happens....
"Employment at will" does not invalidate your notice period requirements. If you have an agreement with your company for a notice period, as long as it is not unduly restrictive, 90 days is probably arguably restrictive, you will have to honor your word.

USA has a right to choose who they give green card to but not fool Indian people by swinging visa bulletin by 4 years every now and then. Not by discriminating. There should be some transparency to the process and law should be followed. If USA makes a law that Indians wont get GC in EB, I am happy to note. Can they remove their gloves?

As we move forward we are leaving behind a good legacy...as you may know the previous guys who fought the retrogression battle in 95 or so did not remove the hard country cap..if they had..then it would have been easy for all of us...we silently continue to work and churn out good things...any organization with a vision would do just that..

A lot was said above but some basic things still need clarification.
I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege...

It was a ridiculous mail by chanakya..If we keep accepting the system as is then there will be no change. we have to make efforts to change the system, clean the system or make it better. And to everybody else, yes the system is defined to bring in cheap labor and exploit them as much as possible. Otherwise it would be ridiculos in the 21st century to be worrying about immigration. Can you imagine when billions of dollars can cross boundaries within seconds without any rules, destroying lives for many, creating new for few..If we can allow capital to do that, why should labor be restricted? and then why do we call it free market?

Does your old company withdraw I140? If the answer is No, then you should move.
My priority date is Jan 04 EB2 and I have a very good job offer. I am in dilemma whether to change the job or just wait for the PD to become current. I have recently got my H1 approval for 3 more year on the basis for 140 approval.

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.

All those who are questioning my profile details please check the public profile of mine. It has more info than most of you (Mr.internet) have in your own. To those who are calling to close this thread - Already someone modified the poll and added two new options, I won't be surprised if it is closed. If it is it will only show how fake some of you are when you talk about a few reasons ( not all) why GC backlogged should be solved fast.

There is not much we can do. From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.
Stay tuned and I will keep on updating here on this nice thread that you created...i really appreciate it. Keep up the good work buddy!!

You seem to believe in all the conspiracy theories out there. India is no more a third world country. There are many deep pockets and if there was any such arbitrague existing people will mint money all day long. Rupee is not fully floating currency that doesn't mean you can control what the exchange rate is going to be. No company or congolmerate can manipulate market like that.
Yes, we are not a third world country. Thats why we still see people like Harshad Mehta and Abdul karim Telgi. Both stock market and stamp paper, backbone of indian economy could be easily exploited by two individuals.
We are still manipulating the stock market. From 3000 to 21,000. Every sadhus, saint, soothsayers, magician, poojari's, astrologers predicting sensex to touch 35,000 by this year end. Even one guy predicted, 50,000 points in 2010.
I am just telling the fact. Look at TOI and other online newpapers economic section. Read the past year news.
Side note: stable oil(price) is the backbone of world economy. We know who manipulates this oil market and who gains out of it? Is it not a few corporations? But tell me honestly how many countries are affected by this inflated oil price.

Point here is: if this can happen in the developed nations, why not in India?

It is widely known fact that Members may be even reluctant to answer the same question again and again ... but unless a legislation is passed , PD will not move.
Unless there is reform....it is very likely that EB2 India would stay where it is today for a very long time....It may even retrogress further...In 96-97 there was a time when EB3 was better than EB2.....That might not happen ...but EB2 India is definately not gonna be too much better than EB3...All people are now trying to get into EB2 wagon and that is gonna is almost as bad as EB3 .....

Whatever the hide and seek game be, we the actual filers will never suffer.
Adding to that there is an independent case already filed in the US courts, so we are on a stronger wicket.
Again, USCIS cannot keep our application in cold storage without extending us the benefits of pending I-485 application.
We will get the good news soon.

I hope I am totally wrong , but if USCIS has decided to put July 2nd applications in COLD STORAGE , then July 2nd filers are in for a long & bumpy ride.I hope we don't become the rolling stone in the game between AILA & USCIS.
What a shame? For hiding their own shortcomings , they are playing such horrible games with our future.

I'm thinking of buying Atlas America Comprehensive with $100 deductible for my Mom. It's coming out to be $991.00 for 6 months approximately.
Friends, if you have any complaints about Atlas or much favorable things to say about other insurance companies, Please suggest me.

We recently got the Atlas America Insurance with 0 deductible and got two visits done for my father(chest infection). Got antibiotics prescribed, blood test done, physical checkup done. Went very smooth, no payments at all.
Said that, someone who has tested a Emergency visit or a Specialist visit or an Intensive care visit should be able to give us a better idea of who fares better.
Till date, other then a PCPs visit, I have not heard any good reviews for any insurance cos(agents).
And then there are so many agents/sub-agents floating around, that even the genuine ones dont seem so genuine.
We should have a AM/S&P kinda rating system for Visitors insurance.

You don't indicate what stage your application is in (LC/PERM, 140 etc.) Is there a reason your prospective employer has not applied for an H1-B so you can start work before you get a greencard? (This is what 99% of EB applicants have done.)
Assuming they can't or won't, to answer your specific question here is my opinion (FWIW I'm English, EB-3 ROW with a PD of May 2003, on my 8th year of H-1B employment in the USA.):
My guess is the odds are about 50/50 that some form of immigration reform will be passed by the US government "soon" that would positively affect EB3 ROW. The practical definition of "soon" in this case is by September 2007, which allows time for debate, compromise, Presidential wanking around and who knows what Kafka-esque delays in actually enacting the law.
IF this happened there is still no guarantee this change would be positive enough to entirely clear the backlog that so a PD of June 2006 might still not to become current by September 2007.
IF this doesn't happen there is practically 0 chance of any changes that would positively effect EB retrogression prior to March 2009. (After the new government is elected in November 2008 AND then convenes a new session AND then deals with more urgent business than immigration reform.)
So some (hopefully) practical advice:
1) If you can get an H-1B now then do so
2) If you can't get an H-1B start studying for a Masters NOW. This will help you in the long run even if you get your Greencard through EB-3 because higher degrees from the UK are very valued in the USA. And if there is no improvement in EB-3 you at least have a chance at EB-2.
3) If you have no family ties and just want to go someone in North America you would almost certainly be eligible for permanent Canadian residency. You can just go to their website and fill out a simple, points-based questionnaire online. Then you can always visit the Disneyland from Canada!

First of all Congratulations desi#### and thanks for continuing to support IV.
Interesting discussion going on. Yes, I agree that most of us here are waiting for our GC and some of them go on to become US Citizens.
I believe that becoming a citizen of any country is a person's choice, so let us not give desi### a hard time here.:o
But I certainly do not think it is an 'achievement' to get a US citizenship, just because it implies indirectly it is an 'achievement' to let go off Indian citizenship. Nothing meant to offend you desi#### but it hurts when one reads such a statement somewhere deep inside the mind. But hey, as I said earlier, to each his own and noone should be judging others in their decisions.
And it is not only Indians becoming US citizens every year. There are others too.
Personally, even with all the advantages as stated above of being a US citizen, I will never let go of my Indian passport. Even if the authorities give it to me tomorrow in a lottery;) Never.
Why? Because my identity, my rich heritage, my family roots, my parents, my culture everything is Indian and am proud of it. There are lot of sentimental and emotional attachments. I was going through the OCI articles today after reading this discussion.
It is not exactly a dual citizenship. Some clauses are no voting rights! No Indian Passport!
Getting a GC is another thing, but when I decide to go back after a couple of years, I would definitely want to retain my voting rights. ! I rest my case.
US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.
Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.
