Now that you are on EAD, what is your plan of action if your I-485 is denied (for a valid/invalid reason)? What do you think of (1) above?
AS I understand : After 6 years, the moment I-485 is denied H1 becomes invalid.
Employee-Employeer can be in agreement to use "Unauthorized work protection - 245(k) - six months", continue to work and immediately apply MTR.
This is complex area and I don't understand fully. Please don't give red dots for these tough questions. I already reduced giving answers from 5-6 per day to one in 5-6 day.

Ok here is my experience,
had a hard LUD and received RFE for 325A and birth certificates,
Replied to RFE - USCIS received the mail on the 8th, same day in the evening, received a hard LUD saying, RFE response received and is under process.
Till today, I have been seeing soft LUD on our case, I dont know what is going on !!!

Going by the accident Scenario.
Friend of mine involved in similar situation..
and the cop who came on the scene given ticket to every one except car7.
Reason he quoted is every car has to maintain enough distance(not sure how much by law :confused:)... Had they maintained enough distance they would not hit the car in front of them even somebody hits you from behind..
So Car3 has no right to SUE you..

-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

In any case, you must defend yourself. If you just run away, then you might find yourself in 3 million dollar debt and all your assets frozen, even in India (assuming you are not planning to live the life of a fugitive!).

Total AOS applications pending as of June-2008 is 740,969.
What percentage of them is Eb-3? where did you get that 55% from?
What % of EB3 is from india? Where did you get that 30% from?

This pending AOS number (740,969) includes family based AOS and EB based. So we should ask them how many of these are EB based (including EB2/EB3).
Mr Gotcher said one time that there are about 400K EB cases pending. So if that is true and USCIS doesn't waste any visas going forward then this backlog should clear in about 3-4 years assuming same rate of new applications in EB2 category

It is taking about 8 to 9 business days to process. This does not include the courier time. For my wife's passport we got it after two days because VFS handed the passport to Blue Dart after the cut off time at Chennai. We had our interview on 7th of Dec and we got our PP's on 20th and 22nd. I would not recommend any changes to the airline tickets until you get your PP in hand.

If you are not in india, then you are somewhere to earn more than you do than in india. So investment is safe if you can afford to invest in that property without a loan. If you are taking a loan you are getting ripped off. STOP there.
to me agricultural land is next to investment in gold. agri land always holds value(sale value) or appreciates over time. Always you can get decent return by farming something there. So my belief is you always get 6%+ return on investment over short/long period of time.
city properties are just a ripp off. So get only one property if you want to live for yourself.. Investment of say 50 lacs on a flat(condo), may give you a good rent. But for how long? and what % of interest you pay on that loan? And what will the aging affect be on that flat!!...

I guess I may fall victim of FBI background check. Even though, my priority date is not current yet but, it should be next couple of months based on recent EB-2 movement. We had our AOS interview last Nov and IO told us that she is going to initiate another Background check as original BC is more than two years old. In the end of April, I made an Infopass appointment out of curiosity because Background check use to be a major source of delay for many people. Service Rep on window told me that my Background check has not come back yet.. It was almost 5 months since it was ordered.. She did not elaborate on why was it pending.. She asked me couple of weird question which did not make any sense to me. I have schedule another appointment in next couple of days to find out where do I stand. I would like to keep my expectations in check as pending BC can delay it even when priority dates are current.
Can anyone on forum please provide some info on what can be done if Background check is pending over 180 days.. I can make a request to my Congressmen and ask for their help... Any suggestions will be greatly appreciated..

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment? :)
Why do think that "India" is the name of 1 human being that everyone from India should be treat like 1 person. Each person applies for his/her I-485, even each member of a family is considered separate. So why club one group of people based on a dichotomy that works best in your favor and then argue that there should be no change. Why not apply color of skin to decide the limits, or maybe the language. As far as the fund drive is concerned I disagree that without the VB we would have not reached our goal We over 22.5K in 6 days. The VB provided a push but I am sure we could have collected the remaining 7.5K in 24 days.

Guys, For better marketing our plight wearing business suits for rallys will have a significant impact on the perception of the rally on both onlookers and the press. It will immediately convey :

The difference between previous illegal protestors and legal high skilled protesters
People will notice crowds of business suits and it will leave an imprint on their mind. Especailly in places like bay area they will just stick outOrganizers may want to think about this.

This may be a rudimentary question, before I ask this Q to my attorney, I wanted to get some information from the public who are in the same boat as I am...
My PD is Dec 2005. I have 2 more years of valid H1B visa time.
Lets assume that I apply for my 485 in a month or two and that I get my EAD by november. I hunt for my "right" partner and get married after november and I plan to get bring her to US of A... here are my Q's
1) Is my H1 going to be valid after I get my EAD approved?
Yes h1 will be valid.
2) Do I "have" to use my EAD card and discard my H1 at all? Can I travel back and forth to India on my H1 even after I have my EAD?
No you can still maintain both the status. H1 gt invalidated only if you use EAD for other job.
3) Suppose that I bring my wife on a valid H4 through my H1 (even though I have my EAD - I am assuming that for question #1 & #2, the answer is 'YES')
I can file her I485 as long as the dates are current (or current to my PD atleast). Now, in a case if the dates are not current, I can still have my H1 in a valid state so that my wife's status is not in jeopardy.... Now the big question is .... if my I485 gets approved without my priority dates getting current to my PD, what would be status of my wife?? Can this ever be possible?
She can enter on H4 and it is not possible to get I-485 approcal with PD current.
