Looks like this Sheila is in her new avatar, from 3 year degree people trying to make $$$ in others troubles! She threatened to sue IVians for exposing her tricks when she tried to advt her service in her posts, as friendly posts.
USCIS does not buy her evaluation anymore. Go to her and lose your valuable time and few thousand dollars in addition to your I-140.
I aso suspect the same...I have asked her the website and there is no information so far. Guys dont fall for her.

Pappu, your inbox is full and cant take any more messages .. I have a suggestion, there may be members willing to spend time to help at the same time they may not able to spend hours / Daily but hours / Weekly. They probably can be assigned meaningful tasks to help you.

My impression from the description of the original poster, , which could be incorrect, is that the first 5 cars were at a stand-still or barely moving (due to traffic jam or red light); the OP or the 6th car hit the line from the behind. It is not about tailgating.
I am sorry, I should have worded it properly. My message was for people tailgating too close. On a rainy day, one of my friends skidded and hit a vehicle in front of him when it stopped suddenly, but he was the one given the ticket.

Chanakya, whatever your arguments may be but calling the current state of EB2-I a "plight" is a little crazy. We are seeing one of the biggest advancements in PD dates for EB2-I. I can understand if an EB3-I feels outraged after reading your post.
I'm EB2 myself but a little empathy would be a good thing... :)

Here are the few main reasons for retrogression to India and China etc are
1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.
2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.
We need to educate the USCIS why and how we are suffering in getting GC.
there is no need and use of blaming Desi companies. I do not support any illegal activities like sale of Labour certifications .
We all know about supply and demand theory which causes black marketing.
Selling of approved labour ( which has old PD ) is also same thing.

Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..

Why ??
Because visa availability date was Current during July 2007 for EB2 and EB3 and it never got advanced beyond that.
So anyone who got their labor applied (PD) after July 2007 didnt get chance yet.
There will certainly be folks with EB1 though.

Have decided to dump my H1 for good and start EAD on my new AC21 job soon.
getting job on EAD is much easier than h1b sponrsorship. AC-21 law was created to protect employee because of processing time taken by INS at that time.
At that time, USCIS ( former INS ) was taking probably more than 1 year.
By law, you can safely jump on 181 days and a lot of people are thinking of that for whatever reason. But my take will be that you should not jump on new job if
- If you are relatively stable in ur job and compensated ok.
- ur PD is very old (2001-02) because you case may be close to adjustication.
- You may have greater challange keeping ur new job if economy went south
if you get laid off from a job then it is much better to get a job on EAD rather than H1b. Probably underlying intention was AC-21 to protect alien in case he gets laid off. I know a lot of people take taken advantage of AC-21 and it is good.
BUT final regulation has not been published and USCIS final rule of AC-21 may be severely restircted in final rule (especially with July VB fiasco)

jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
Otherwise, why would they touch a EB3-I case with PD of 2005.
I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!
Your situation confirms what I believe. They touched your file, because in the sequence of paper file receiving, your file is next. While issuing RFE, adjudicator did not even look at your PD or chargeability. When it is all clear, then perhaps they will open the page where PD and birth country are written. If at that moment in time your PD is current you will be cleared, else back to same (or some other) pending stack of files.
RFE could be for so many things, birth/medical certificates not acceptable, something is not properly signed, photos missing, passport photos not clear, etc.

I have very high regards for Aman due to his dedicated efforts. 64K he spent is the big big amount as an individual.
I suggest, lets have a request to Bollywood artist to organize some shows at USA in benefit of IV (they may give us some discount). We shall pay back 63K to Aman (IV can keep 1k as his contribution).
Other option is 630 people should contribute $100 each to pay back Aman. I received my green card and ready to contribute $100 to this account. I already contributed $700.
