Sensenbrenner Statement after President Bush's Speech on the State of the Union
WASHINGTON, D.C. -- In response to President Bush's speech on the State of the Union, Menomonee Falls Representative Jim Sensenbrenner issued the following statement:
“President Bush’s speech tonight was a strong and visionary statement that accurately reflected the state of our union. Since his last such address, our nation has gone through waves of lows and highs. From the horrors of Hurricanes Katrina and Wilma, to the December elections in Iraq where the Iraqis chose their first representational government under their new constitution, Americans have experienced both great pain and great elation.
But as the President said, ‘Our work in Iraq is difficult because our enemy is brutal.’ This brutality is continually demonstrated by the actions of terrorists who prey upon innocent men and women to preach their message of hatred. As our nation makes progress in the War on Terror, I hope to see our sons and daughters return home from their tour of duty -- American soldiers will stand down as Iraqi soldiers stand up.
On the subject of immigration, I was pleased to hear the President discuss the need for orderly and secure borders, and a plan that calls for stronger immigration enforcement that, among other things, rejects amnesty for illegal aliens. There is much work that remains to be done as we try to build consensus. The Border Security bill I introduced and the House passed last year is just the first step towards a comprehensive immigration plan. Currently, our immigration laws rival our nation’s convoluted tax code.
This highlights our need to hold the line on spending in Congress. In order to maintain America’s competitive edge, a recurring theme through the President’s speech, we must spend our taxpayer dollars wisely. I agree with the President that the federal budget includes too many special projects, better known as “pork.” To that end, I support providing the President with a line item veto.
Tonight Congress has been challenged to act on many issues. I accept the challenge laid down by President Bush to deliver common sense legislation that will continue to improve our security and quality of life.”

My reading is that sensenbrenner seems to be open to consensus...and amenable to comprehensive reform (which in other words is tougher border security and interior enforcement + guest worker program similar to Coryn-Kyls'). Despite public rhetoric, if there is enough time we may see such legislation come to pass in the 109th Congress. We need to see how we can bring about meaningful EB visa relief in such a scenario.

On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.

I had checked with my attorney, he had mentioned that I could keep on working till my H1 expired.... I will recheck with him.

For all practical purposes, the date on which it was recieved is your RD=> Receipt Date. The postmark date has no relevance except for records unless USCIS explicitly states so ( which it did once in 2001 http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=89a5f3cee754ad0499e55e731191f 360).
485 filings are strictly Receipt date. I am still searching for the uscis link and will post one as soon as I find one.

For that matter nothing is an achievement. if Some one gets a baby everyone greets him. Is that an achievement? If you buy a house you are happy. Is that an achievement? For some people coming to US was an achievement. Some people think getting a green card. We see all congratulation message when someone get his GC.
So Please be broad minded. It may be nothing for you. But for some people it is an achievement. People like me are happy by achieving small things. This may nothing for you But it is good reason for the celebration for the people like us.

long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?
Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

Logiclife made a good point "immigration right" but I dont know how this thread got morphed into marrying local and what not.
The point is your whole attitude is wrong. First lets get one point straight. We are doing this country no favour by working here nor is this country doing us any favour by letting us work here. Its a mutually benefecial scenario. Since we are contributing to this society and following all there rules we are asking for immigration rights.
To ask for something, you must first believe that you deserve it. The illegal aliens belive in there cause (even thought they broke the law) that is one of the reasons everyone talks about there cause including the senators, president and the media.
People like you on the other hand seem to belive in taking handouts and nobody cares about such people. unless we belive we truly deserver it nobody is going to give a damn about us.
I dont mean to say anything personally to you I am just addressing people who seem to disagree with logiclifes well articulated argument about immigration right.
In same vein, driving on road is privillege not a right.
With 'privillege' you have to follow existing rules religiously then if it was a 'right'.
In anycase, what we can only do with existing law is work with law makers and not protest.

That is India time....
If you transfer less than 1000 USD to outside SBI, they will charge 25 rupees, the only problem is that they will not specify that charges any where in the transaction.....but it will be accurate all the time....

This can financially drain you out. My insurance agent told me that they cant get the money straight out of your bank account , because how will they find out your bank account number and the bank? How do they know how many bank accounts you have? What if you send money to India before the judgement is entered against you? If you have a house, they can go after your house or car. What about their own insurance policy? Maybe their insurance can also pay as uninsured motorist pay? Retirement income is usually protected in some states and hence I dont think your 401K is at risk. Once your insurance company pays out the maximum, you can basically say hands up, I have given up.
I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?

For all of you who have got standard responses from USCIS, please do something about it. Call the local senator, file DHS-7001 with CIS Ombudsman, send a letter to USCIS secretary Napolatino, call TSC using POJ method, etc, etc.
If you are current, they need to look at your file. Case under review means nothing at all....my case was under review since July 20, 2009. Finally, i found out that my file was sitting in the storage and collecting dust.
As other previous posters have mentioned, you should try calling TSC/NSC on Thursday/Friday evening. I found out that the IOs were in a better mood, as compared to my calls on other days (specially in the morning/afternoon).
If you need details on the IO I talked to, I can provide it to you offline. I am still trying to reach that IO (need to say a big thank you) but have been unable to talk to him/her so far.

Calling does help in many ways. People have to think positive rather than berating an effort.
Based on the original post, I infer that lawmakers won't care if they receive calls from LEGAL Aliens. If that is the logic then why do you think that lawmakers will work on "immigration" bills. After all the "immigration" bills only benefit folks who don't vote immediately. But one of lawmakers duty is to build the next generation America, and "immigration" bills benefit next generation America. People got to understand this fundamental difference and stop being pessimistic about IV efforts.
Directly talking to lawmakers office (through phone or in person) is far more effective than Web faxes and digital signatures.
I just cannot understand how high-skilled folks can be so short sighted, Look at the big picture.

I think this is great idea EB3_NEPA. We need to work on this!!! A good interim solution. That way we can actually show the contribution that we can make to the society as a family. Does anyone have an idea where we can start?
How about sending letters to our representatives and then contacting the media on the plight of our spouses rather than on us!!! May be the human rights folks can help us on this.
